Virsono Hearing Centers operates licensed hearing healthcare clinics across the United States. We are a covered entity under the Health Insurance Portability and Accountability Act (HIPAA).

Clinical health information collected during your appointment, including your hearing evaluation results, treatment recommendations, fitting data, and billing records, is Protected Health Information (PHI). PHI is governed by our HIPAA Notice of Privacy Practices, which is a separate document available at any Virsono clinic location and on virsonohearing.com.

This Privacy Policy covers information collected through virsonohearing.com, our online forms, our SMS communications, our marketing emails, and other non-clinical interactions. Where information collected through these channels intersects with clinical care, that intersection is governed by HIPAA and our Notice of Privacy Practices.

Virsono Hearing Centers is a multi-location hearing healthcare network providing diagnostic audiology, hearing aid fitting, and hearing-related care across the United States. Virsono is a subsidiary of Earlens Corp, a California-based medical technology company that develops and commercializes the Earlens Contact Hearing System.

Virsono Hearing Centers operates virsonohearing.com and its related subdomains. Our clinic locations operate under applicable state licensure and federal healthcare regulations. As a healthcare provider, Virsono is a HIPAA covered entity. Our regulatory and compliance practices reflect that status.

As a subsidiary of Earlens Corp, Virsono Hearing Centers uses the Earlens corporate privacy infrastructure for handling privacy inquiries and data requests. Privacy correspondence directed to privacy@earlens.com is processed by the Earlens privacy team on behalf of Virsono. Clinical care, patient communications, and Notice of Privacy Practices obligations remain the direct responsibility of Virsono Hearing Centers as a HIPAA covered entity.

With Earlens Corp (Parent Company)

Virsono Hearing Centers may share operational and business data with Earlens Corp, our parent company, for internal business purposes consistent with this policy. Clinical PHI is not routinely shared with Earlens Corp outside of HIPAA-permitted uses.

6. HIPAA and Protected Health Information

Virsono Hearing Centers is a covered entity under HIPAA. Clinical health information you provide during your care at a Virsono clinic, including hearing evaluation results, treatment recommendations, fitting data, billing records, and clinical communications, is Protected Health Information (PHI). PHI is handled in accordance with HIPAA and our Notice of Privacy Practices.

Our HIPAA Notice of Privacy Practices is a separate document that describes:

  • How Virsono may use and disclose your PHI
  • Your rights regarding your PHI, including access, amendment, accounting of disclosures, and restrictions
  • How to file a complaint with Virsono or with the U.S. Department of Health and Human Services Office for Civil Rights
  • Our duties regarding PHI under HIPAA and applicable state law

Business Associate Agreements

Where a service provider, vendor, or contractor has access to PHI in providing services to Virsono, we enter into a written Business Associate Agreement that requires the partner to safeguard PHI consistent with HIPAA.

Marketing Communications and PHI

HIPAA limits the use of PHI for marketing purposes. Virsono does not use PHI for marketing or advertising purposes without your specific authorization where required by HIPAA. Where you have provided SMS consent for service or appointment-related communications, that is treatment or healthcare operations communication, not marketing.

7. State Privacy Rights

Virsono Hearing Centers operates clinics in multiple US states. Depending on your state of residence, you may have specific privacy rights under state law in addition to your rights under HIPAA. The most prominent state privacy laws applicable to our operations include the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). Similar rights may apply in other states including Colorado, Connecticut, Virginia, Utah, and others.

Include your full name, email address used in your interactions with Virsono, your state of residence, and the specific right you wish to exercise. We will verify your identity before processing and respond within 45 days. One 45-day extension may apply for complex requests.

8. Opt-Out of Sale and Sharing

Virsono Hearing Centers uses advertising cookies and retargeting pixels that may constitute sharing of personal information under CCPA/CPRA. California law requires us to provide a clear and accessible opt-out mechanism.

Do Not Sell or Share My Personal Information

A Do Not Sell or Share My Personal Information link is available in the footer of every page on virsonohearing.com. Clicking this link allows you to opt out of cookie-based advertising data sharing in real time. Your preference is saved and honored on future visits. This opt-out covers advertising and retargeting cookies only. It does not affect information submitted through contact forms or PHI collected during clinical care, which is handled as described in Sections 2, 3, and 6 of this policy.

10. Children's Privacy

virsonohearing.com is intended for adults. We do not knowingly collect personal information from children under 16 through our website without verifiable parental consent. Where Virsono provides hearing healthcare services to minors, those services are provided with parental or guardian consent and the resulting clinical records are handled as PHI under HIPAA. If you believe we have inadvertently collected information from a child under 16 through our website, contact privacy@earlens.com immediately and we will delete it promptly.

11. Security

Virsono Hearing Centers implements reasonable administrative, technical, and physical safeguards to protect personal information and PHI from unauthorized access, disclosure, alteration, or destruction. These include encrypted data transmission (TLS 1.2 or higher), access controls, secure hosting infrastructure, employee training, and HIPAA-required safeguards for PHI.
